: (1) When recording any communication in accordance with this paragraph, such recorded communication must be done in such a way that it cannot be edited, tampered with, changed or deleted.
(2) A person who records in violation of sub-section (1) shall be deemed to have committed an offense under this Act by being intoxicated.
